Program Terms and Conditions

Wiivo is a premium membership program, which is operated by Wiivo Inc./ Acheteurs Bizz Inc. organized under the Canada Business Corporations Act ("Wiivo”).

Wiivo is solely responsible for conducting and administering the Program. By Enrolling in the Program in connection with your membership account ("Account"), you agree that you have read and understand these Terms and Conditions and are bound by all of them, as may be changed from time to time, and you consent to Wiivo’ collection and use and disclosure of your personal information in accordance with the Wiivo Privacy Policy (at https://wiivo.com/privacy-policy) as may be amended from time to time and incorporated herein by reference. Further, you acknowledge and accept these Terms and Conditions as a condition of continued membership. Wiivo specifically reserves the right to amend, alter, withdraw or terminate the Program, any Program benefit or award/reward, including but not limited to any discount available or potentially available, or these Terms and Conditions either with or without notice. Any such changes may affect the availability and specifics of benefits previously available or potentially available under deals. Enrolment, membership and all related benefits of the Program and deals are offered in the sole discretion of Wiivo.

These Terms and Conditions constitute the entire agreement between you and Wiivo regarding your participation in the Program and the use of Wiivo benefits, your entitlement to redeem discounts and your entitlement to any other benefits of the Program, and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise. When you deal with Wiivo or its Partners over the Internet, you consent to the formation of contractual relations through electronic communications. Wiivo has the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Program and Wiivo Rewards.

Participation in the Program

1. Wiivo members must be 18 years or older, and Canadian residents.

2. A Wiivo member ("Member") must enroll individually in his/her full legal name and such person may have only one open Account at any given time;

3. A Member may only receive benefits in one Account. Membership is solely for the benefit of the individual; therefore, it must be maintained in the name of an individual; any duplicate accounts can be removed at the sole discretion of Wiivo;

4. Rewards and any entitlement to redemption thereof are personal and cannot be assigned, traded, or otherwise transferred without the prior written consent of Wiivo or otherwise in accordance with the Terms and Conditions of the Wiivo Program, as may be amended from time to time. Any assignment or transfer in violation of these rules will be void and may, at the sole discretion of Wiivo result in the loss of membership or the cancellation of the affected Rewards redemption entitlement, as the case may be;

5. To be eligible to redeem Wiivo benefits, an individual must be a Wiivo member and/or be a customer of an associated Partner in Wiivo. This Wiivo membership will be associated with one Account number.

7. Wiivo assumes no liability whatsoever, including without limitation, liability for any expense, loss, cost, injury, damage, accident or any other matter or thing whatsoever, however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to the Program or by reason of the termination of or amendment to the Program in whole or in part, any failure by Partners of BizzShoppers to honor any rewards, offers of promotions by such parties, or the addition or deletion of reward partners or other features with or without notice;

8. Wiivo membership and participation are privileges which can be revoked by Wiivo in its sole discretion at any time and without compensation for any reason including without limitation, for abuse or breach by a Member of any of the Terms and Conditions of the Program or any other actions deemed by Wiivo, acting in its sole discretion, to be contrary to Wiivo, the Wiivo Program, or the interests of its Members or reward partners;

9. Wiivo shall be under no obligation to continue the Program, or to provide any notice of its termination;

10. Each Member shall be responsible for advising Wiivo of any change of their name, billing address, e-mail address or any other required membership Enrolment data. Neither Wiivo nor its Partners shall be liable for misdirected communications such as mail or e-mail or any consequences thereof;

11. Neither Wiivo nor its Partners shall be responsible for any failure of the Wiivo website or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any email, online or Internet entry. In addition, neither Wiivo nor its Partners shall be responsible due to technical problems, traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any computer or property related to or resulting from participating in or downloading any material relating to the Program. BizzShoppers reserves the right, at its sole discretion, to cancel or suspend the Program should a virus, bug or any other cause beyond the reasonable control of Wiivo corrupt the security or proper administration of the Program. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Program is a violation of criminal and civil laws, and should such an attempt be made, BizzShoppers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution; and

Membership Enrolment

1. To participate in Wiivo benefits, a Member must have applied for, been granted and possess a Wiivo membership;

2. To enroll, you must have a valid Canadian address, a valid e-mail address and be a minimum of 18 years of age at the time of enrolment;

3. To become a Member, simply complete a Wiivo Program online Enrolment membership form available at the Wiivo website accurately and completely;

4. Enrolment also requires the creation of a password or a personal identification number ("Password") which is required to access your Account online. Certain password creation rules may apply and Wiivo reserves the right to change password creation rules to adhere to the strongest privacy and security standards in place. Anyone who knows your Password and Account number will have full access to your Account. You are responsible for maintaining the secrecy of your Password, for all activities that occur using your Password and for notifying Wiivo of any unauthorized use of your Password. Wiivo is not responsible in any way for any loss arising from unauthorized use of your Password or your failure to comply with these provisions;

5. By Enrolling in the Wiivo Program, you consent to receive Wiivo communications as well as other communications containing special offers about the Wiivo Program and its rewards and services, which communications may incur data charges if accessed or received via a mobile device.

6. Wiivo does not collect personal information on its website from individuals it actually knows to be under 18 years of age. The Program is not marketed to or directed towards:

- People under 18 years of age;

- Non business people or entrepreneurs;

- Non professionals (professional definition: a person who is member of a profession or any person who earns a living from a specified professional activity);

- Non-Canadian

residents.

Wiivo requests that website visitors under 18 years of age, people that are neither entrepreneurs or doing business, and non-Canadian resident people not to disclose or provide any personal information. If Wiivo discovers such information, it will delete the person’s personal information from its records without prejudice. If for any reason Wiivo believes a user may be under the age of 18 or is not a Canadian resident, it reserves the right to request proof of age, or residency of such user. If such proof is not provided, or if it is discovered the user is under the age of 18 or is not a Canadian resident, all personal information regarding that individual shall be deleted from the Wiivo system and Wiivo reserves the right to limit and/or ban the user from membership in the loyalty program;

7. Note to Parents. Wiivo encourages parents to supervise their children’s Internet activities and to consider using parental control tools available from online services and software manufacturers that help provide a child-friendly online environment. These tools can also keep children from disclosing online their name, address and other personal information without parental consent.

8. Enrolment at the Wiivo website is subject to verification and will be deemed invalid if the information is not true and/or complete.

Membership Activation

Wiivo Memberships are valid exactly one year from the date you activate your Membership online or through the Wiivo App. Wiivo memberships can only be activated online or through the app, activation at participating retailers is not available.

Yearly Membership Subscription

By signing up for a yearly membership subscription, you agreed that your subscription will be automatically renewed and, unless you cancel your subscription, you authorized us to charge your payment method for the renewal term. You agree that we can change the terms of the subscription with advance notice to you and an opportunity for you to cancel. The period of auto-renewal will be the same as your initial subscription period unless otherwise disclosed to you. The renewal rate will be no more than the rate for the immediately prior subscription period, excluding any promotional and discount pricing, unless we notify you of a rate change prior to your auto-renewal, in which case you will have the right to cancel the renewal of your subscription.

Termination or Cancellation of Membership

You can cancel your Wiivo Membership services at any time. More information on how to cancel can be found on FAQs. Once you have cancelled your Wiivo Membership and received confirmation, no other changes can be made to your account. The cancellation of a Wiivo Membership will go into effect at the end of your current billing cycle, and you will have the same level of access to Membership services through the remainder of such billing cycle. For example, if you are billed on a yearly basis and cancel during a given month, you will be charged for the entirety of that year and maintain access to the membership services through the end of that year. There are no refunds for termination or cancellation of your Wiivo Membership. If you no longer wish to subscribe to a Wiivo Membership, it is your responsibility to cancel your Wiivo Membership in due time, regardless of whether or not you actively use the Membership.

Membership Fee Changes

Billing Information

Should you register for a yearly membership, we automatically bill your Payment Method each year, on the calendar day corresponding to the commencement of your paid membership (which will be set out on the page of the Wiivo website or app on which you made your order). Our billing services may be provided by another related vendor, and payments for your Wiivo Membership may appear on a user’s bill as being charged to another related vendor we use for this purpose. As used in these Terms of Use, "billing" shall indicate a charge, debit or other payment collection, as applicable, against your Payment Method.

Payment Method

To use Wiivo membership services you must provide us with a Payment Method. You authorize us to charge any Payment Method associated with your account in case your primary Payment Method is declined or no longer available to us for payment of your Membership fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the membership until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.

Earning Rewards

1. From time to time, Wiivo may invite reward Partners to work with Wiivo to provide more benefits and opportunities to Members. Wiivo may also advertise offers for which Members may earn additional benefits;

2. Members must present their digital valid Wiivo membership card and, when requested, to receive benefit from discounts in store.

3. Any unauthorized reproduction of a Wiivo card may lead to a deduction of or loss of all eligibility to redeem Rewards that may be associated with such Account, exclusion from the Program and may have additional legal consequences, all in the sole discretion of Wiivo;

4. Wiivo or a Partner may refuse to record or honor Rewards redemption eligibility associated with your account or may cancel such eligibility if Wiivo cannot confirm via Wiivo systems, transaction receipts and other information that such eligibility was properly issued or obtained. Any Rewards, offers or promotions not honored by Partners are the sole responsibility of such Partners and not Wiivo; and

5. If you believe that any Account statement reflecting your eligibility for Rewards is in error, you must contact Customer Service (1-877-737-2499) within 60 days of the date of the Account statement or such statement will be deemed correct, except for excess Rewards eligibility improperly noted in your Account. Wiivo may require that Members submit documentation to support your claim.

Returns and/or Exchanges

In the event of a return and/or exchange of any purchase for which Wiivo benefit was given, your level of benefit will be adjusted downward by an amount equivalent to any previous upward adjustment associated with the original transaction.

Redemption and Benefits

1. Only a Member may redeem deals, if the case may be, and to do so must have a valid Wiivo membership, which must be valid, as well as a valid piece of identification;

2. Your Account number and Password will be required for any available automated or online benefits.

3. You may be required to provide proof of and/or authentication of your identity when using your Wiivo membership, to protect the integrity of your Account and to verify your Member status;

4. Wiivo may include or remove the Program’s additional reward partners in its sole discretion.

Electronic Messages Terms

By clicking the checkbox, the member consents to receiving electronic messages from Wiivo and its Partners. Standard text and data rates may apply. Consent can be withdrawn at any time by clicking the unsubscribe button at the bottom of our promotional emails.
